Water tapping Phoenix Knitting Ltd perd son procès contre la DBM et la CMT

Phoenix Knitting Ltd a perdu son procès contre la Development Bank of Mauritius et la Compagnie Mauricienne de Textile Ltd. Elle leur réclamait la somme de Rs3,442,001 “as a result of defendant No1’s failure to fulfil its obligations towards the plaintiff concerning the supply of water and the illegal tapping by the second defendant at the Industrial estate situate at Pont Fer, Phoenix. Phoenix Knitting Ltd a ainsi détaillé sa réclamation: (1) “payment of water browsers to compensate the shortage in the water supply- Rs1,415,518, (2) interest on the payment of water browsers- Rs226,483 et (c) loss on profit on turnover- Rs1,800,000. Après avoir entendu les parties concernées, le juge Gérard Angoh est arrivé à la conclusion que Phoenix Knitting Ltd n’a pu prouver “on a balance of probabilities” ce qu’il reprochait à la DBM et la CMT
