La magistrate A. Hamuth a prononcé un verdict de culpabilité à l’encontre de Jelon Brian DEux Novembre, qui a comparu en Cour Intermédiaire sous une accusation d’avoir commis un acte indecent sur son cousin de cinq ans, un retardé mental, qui vivait dans la même maison que lui. Selon la poursuite, l’accusé a demandé à l’enfant de lui faire une fellation et d’embrasser sa poitrine.
Le délit eut lieu en 2008. Devenu un adolescent, le cousin a déposé en Cour de telle façon qu’il a convaincu la magistrate qu’il disait la vérité et qu’elle pouvait se fier à son témoignage pour reconnaître la culpabilité de Deux Novembre. Dans son jugement, la magistrate Hamuth explique: “ Taking into account the demeanour of the OJ, I find that I can safely rely on his version to convict the accused in the case at hand. Furthermore, as considered earlier, the evidence of the mother OJ is admissible and indeed shows consistency with the version of OJ. The narration of events by OJ in Court regarding the acts which he was asked by and performed on the accused, as considered in this judgment and the undisputed facts regarding the age of OJ, satisfy all the constitutive elements of the offence preferred in the information. For the above reasons, I find on the unshaken evidence led by the prosecution, proved beyond reasonable doubt, that the accused has willfully and unlawfully committed an indecent act upon a child under the age of 12 ».
